The Petnax.com Acceptable Use Policy is created to protect Petnax and their customers from unacceptable and/or illegal activity over the Web. Account holders of Petnax and the account holder's authorized users are required to behave in an acceptable fashion and to abide by commonly accepted practices of the Internet community in general. The information below serves as a guideline of acceptable and unacceptable behavior on the Petnax website; the guideline does not cover everything and should not be considered comprehensive.
 
General:
This document aims to comprehensively define Petnax's acceptable use policies ("AUP") using Petnax's services that give access to the Petnax's network (the "Network"). By using the Network, you (the account holder) fully acknowledge that you and other users that may have gained access to the Network through your account have completely read, understood and agreed to abide by this AUP document. You, (the account holder) are responsible for all violations of the AUP by any user accessing the Network through your account. This AUP pertains to all aspects of the Petnax Network, including but not limited to websites, email, postings on USENET, web chat and paid advertisements. You are fully responsible for keeping the confidentiality of your password or passwords and private account information, along with the physical security of your and your user's access to the Network. If a verifiable violation of the AUP is committed by you or any user of your account, you completely agree to indemnify, defend and hold Petnax's divisions, employees, members, suppliers, all third party website developers, and providers harmless from and against all claims, actions, losses, liabilities, damages, expenses, demands and costs, including attorneys' fees resulting from that violation. In any event of verifiable abuse or misuse of the Network, or verifiable infringement by you or any user of your account, of any intellectual property or other right of any entity or person, you completely agree to defend, indemnify and hold Petnax's divisions, employees, members, suppliers, all third party website developers, and providers harmless from and against all claims, actions, losses, liabilities, damages, expenses, demands and costs, including attorneys' fees resulting from that abuse, misuse or infringement. You completely agree to totally cooperate as reasonable required by Petnax's defense of any claim. Petnax respectfully reserves the right, at its own expense, to assume the exclusive defense and control of all matters otherwise subject to indemnification by you and any user of your account, and you will not settle any matter without the written consent of Petnax. You completely agree to immediately notify Petnax of all unauthorized use of your account or possible breach of security known to you.

Rights of Petnax:
If the Petnax account holders and / or authorized users engage in conduct that is in violation of the AUP while in the Network, or is otherwise deemed unacceptable, improper or illegal, Petnax respectfully reserves the right to immediately suspend and possibly permanently terminate access to the Network before notifying the account holder. Typically Petnax will try to contact you, the account user, and notify you of any improper conduct or activity that is or may be in violation of the AUP and request that such activity promptly cease. In cases where the viability of the Petnax Network is threatened however, or in matters involving UCE/SPAM, alteration of your IP address information, mail relaying, denial of service attacks, harassment, illegal activities, or infringement of copyright, Petnax respectfully reserves the right to immediately suspend and / or permanently terminate your account and access to the Petnax Network without first notifying you. In addition, Petnax can take other actions, including but not limited to, legal action against the account holder for verified violations of the AUP. This might include immediate and permanent cancellation of the account. Petnax doesn't promise or have any obligation to monitor or police activity and account holder behavior occurring on the Petnax Network, and will have absolutely no liability to any party, including the account holder, for any violation of the AUP.

Forbidden Activities:
The activities listed below are forbidden and can possibly result in the permanent and immediate termination of access to the Petnax Network.
*Intercepting, interfering with, or redirecting electronic communications with others, or attempting to do so.
*Purposely transmitting or transmitting scripts or files may contain or activate a virus.
*The reselling of Petnax products or services, unless a written agreement between you and Petnax has authorized the sale.
*Giving misleading, false or incorrect data to Petnax on online or written contracts, applications or other materials or documents provided to Petnax, including fraudulent Paypal accounts, credit card numbers, "bill to" addresses and phone numbers.
*Attempting to alter or modify the procedures, programs, scripts, processes used by Petnax to measure bandwidth usage, time or any other method to document the account holder's usage of Petnax services and products.
All other unacceptable, illegal or abusive activity of the Petnax Network (to be determined by Petnax), whether or not listed specifically in the AUP can possibly result in the permanent and immediate suspension or termination of access to the network, and permanent and immediate suspension or termination of the account holder's account.

AUP Modifications:
Petnax respectfully reserves the right to alter this AUP at any time without notice before the matter. When acceptable or necessary, Petnax will try to notify account holders of such alterations, either through email or posting a revised copy of the AUP in this location on our website.

Mail Server Filters:
The usage of the Petnax Network to send email through an external party server is forbidden. Account holders are held responsible for ensuring that everyone accessing or using the Network under the account holder's authorization comply totally with the AUP.

Systems Security:
Account holders of Petnax are completely responsible for configuring their systems with, at the very least, the basic minimum of security. Should systems or applications at an account holder's site be somehow compromised, the account holder is responsible in sole for reporting the violation and the repair of the exploited system or application. Account holders are not allowed to purposely or negligently insert false/spoofed data onto the Web. For example, invalid DNS or bad routing information is prohibited.

IP Addresses:
Petnax will maintain complete control and ownership of all and any IP addresses and numbers that are assigned to the Client and respectfully reserves in its sole discretion the right to remove or change all and any IP addresses and numbers.
Illegal or Unauthorized Use

The account holder or authorized users of the account may not attempt to gain illegal or unauthorized access to, or attempt to compromise or interfere with the security or normal operations of any network, system or application, including the information and data maintained on that entity. The account holder or authorized users of the account may not use the Network to perform activities that may interfere with the accessibility or use of the Petnax Network or the Web. The account holder may not use the Petnax Network to monitor information, data streams or communications on any system or network without prior authorization. All account holders and the authorized users of those accounts may not attempt to gain unauthorized access to any other account holder's private information such as passwords and account files.

Spoofing / Fraud:
You, the account holder, may not attempt to send or transmit any email or electronic or digital communication while using the name or address of someone other than yourself, the account holder. Attempts to impersonate other people, companies or corporations by changing a source IP address or the usage of forged or spoofed headers or other identifying information is prohibited. Any attempt to fraudulently forge, conceal, spoof or otherwise falsify another account holder's identify in any connection with the usage of the Petnax Network is prohibited.

UCE, Spamming and Mail bombing:
A Petnax account holder and their authorized users may not use the Petnax Network to transfer large volumes of commercial email or purposely send large file attachments to one person. UCE (Unsolicited Commercial Email) is forbidden. Additionally, spamming and mail bombing are also forbidden. Using the service or network of another provider to send spam, mail bombs or UCE for the promotion of a website connected to or hosted on the Petnax Network is forbidden. Account holders may not use the Petnax Network to receive responses from mass, unsolicited commercial email.

Illegal Activity:
The account holders of Petnax and the account holder's authorized users agree to use the Network for only lawful purposes. Use of the Network for storage of information or other digital material like images, scripts, compiled programs or scripts that violates any applicable state, federal or local regulation or law is completely prohibited. Use of the Network for transmission, distribution, retrieval, retransmission of such digital material that may violate any applicable state, federal or local regulation or law is also completely prohibited. This includes, but isn't limited to, the transmission, use or retransmission of all information or digital material that is copyright protected, trademarked or trade secret, patented, or other intellectual right of property, and any other material or information that is digital that may be an illegal threat, violates export control laws, can be considered obscene, defamatory or otherwise unlawful.

Cooperation with Civil and Criminal Investigations:
Petnax cooperates completely with acceptable law enforcement and other parties or agencies that may be involved in investigating claims of unacceptable or illegal activity performed or conducted on the Petnax Network. Petnax respectfully reserves the right to disclose all account holder information to the extent authorized by the relevant statues of federal surveillance.

Additional Terms and Conditions:
Usage of the Petnax Network by an authorized user or account holder is subject to the conditions and terms of any agreements entered into by the account holder by Petnax. The AUP document is hereby incorporated into the agreements by reference.
If you're aware of a violation of this AUP due to any company, corporation, person, including other authorized users that have access to the Petnax Network through your account, notify Petnax promptly, please. Petnax will send you, the account holder, a notification of received complaints concerning every supposed incident that violates this AUP by other users of the Petnax Network authorized by you. You completely agree to immediately investigate any complaints and proceed with required actions to fix all violations of the AUP. Petnax respectfully reserves the right to use and install, or have you use and install, on your account, any acceptable devices specifically designed to filter or permanently terminate access to the Petnax Network.

Limitation of Liability:
Petnax will not be held liable for any incidental, indirect, consequential, special or punitive damages, including not limited to the loss of business opportunities or business, loss of profits, loss of use, etc, even if advised of the possibility of these damages. Petnax will not be liable for any actual or direct damages, except to the specified extent in an electronic or written agreement entered into by Petnax and Petnax account holders. Petnax makes no representations or warranties herein, either implied or expressed, regarding the Petnax Network, and renounces warranties of fitness for a particular purpose or use, the warranty of merchantability and all other warranty connoted by the law.

Complaints concerning prohibited activity, violations of the AUP, or any other abuse of the Petnax Network, should be emailed ( contact us ) to as soon as possible. Include all relevant information that may assist Petnax's investigation of the matter, including all relevant header lines of forwarded messages. External sites to the Petnax Network experiencing live attacks from account holders of Petnax should contact us immediately.
